1. Acceptance of terms

By accessing or using Banana AI ("the Service") at getbanana.ai or through our mobile apps, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of service

Banana AI provides an AI-powered image generation platform that allows users to generate photos of themselves in various styles, settings, and scenarios by uploading reference photos and entering text prompts. The Service includes web and mobile applications, subscription plans, and one-time credit packs.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

4. Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating an account. Notify us immediately at support@getbanana.ai if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the Service.

5. Credits and payments

The Service operates on a credit system. Credits are consumed when you generate images. Credits are available through monthly subscription plans or one-time credit pack purchases.

Subscription credits reset each billing period. Unused subscription credits are forfeited at the end of each period and do not roll over.
Top-up credits purchased as one-time packs never expire and roll over indefinitely.
All prices are displayed in USD. Payments are processed by Stripe.
Subscriptions renew automatically unless cancelled before the renewal date.

6. Refund policy

All purchases are non-refundable once any credits have been used. If you have not consumed any credits, you may request a refund by contacting support@getbanana.ai with your account email and order details.

We reserve the right to issue refunds at our discretion in cases of verified technical failures or billing errors on our end.

7. Acceptable use

You agree not to use the Service to:

Generate images of real people without their explicit consent
Create sexually explicit content involving minors under any circumstances
Generate content that is defamatory, harassing, threatening, or incites violence
Produce content intended to deceive, defraud, or impersonate others
Violate any applicable law or regulation
Circumvent technical limitations or access controls
Use automated tools to scrape, crawl, or abuse the Service
Resell or redistribute access to the Service without authorization

We reserve the right to remove content and suspend accounts that violate these rules without prior notice.

8. Content ownership and license

Your uploads: You retain ownership of all photos and content you upload to the Service. By uploading, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

Generated images: Images generated by the Service are yours to use. All paid plans (Starter, Pro, Ultra) include a commercial use license. You may use generated images for personal and commercial purposes including social media, marketing, and print.

We do not claim ownership of your generated images and will not use them for advertising or resale without your consent.

9. Intellectual property

The Banana AI name, logo, website design, and underlying software are owned by us and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our written permission.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated images will meet your specific requirements. AI-generated images may occasionally contain artifacts or inaccuracies.

11. Limitation of liability

To the fullest extent permitted by law, Banana AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, lost profits, or business interruption. Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

You may cancel your account at any time through account settings. We may suspend or terminate your access to the Service at any time for violation of these terms, abusive behavior, or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately.

13. Changes to terms

We may update these Terms of Service from time to time. We will notify you of material changes by updating the date at the top of this page and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the updated terms.

14. Governing law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
